Terms of service
Effective · Last updated
These terms govern your use of the Shopify apps, mobile apps and websites provided by Fleek Apps LLC, a Delaware limited liability company (“FleekApps”, “we”, “us”): FunctionFlow AI, SmartSort AI, ShipRule and Rack Scanner (each an “App”), and fleekapps.com, help.fleekapps.com and rackscanner.com (together with the Apps, the “Service”). These terms are an agreement between you and Fleek Apps LLC. By installing or using the Service you agree to them. If you use the Service on behalf of a business, you accept these terms for that business.
Custom development, consultancy and other project work is governed by the proposal or agreement for that project. Where it doesn’t cover something, these terms apply.
1. The Service
Each App adds features to your Shopify store, as described on its page and in its documentation. Features available to you depend on your plan. We may improve or change features over time.
2. Your Shopify store
You need an active Shopify store and must comply with Shopify’s terms. You decide how each App is configured, and you are responsible for the settings and rules you publish and for making sure they comply with laws that apply to your business, such as consumer protection and pricing rules. Test changes that affect your checkout or storefront before relying on them.
3. Accounts and access
You are responsible for the staff you give access to an App and for the changes they make through it. Keep passwords and connection codes confidential, and tell us promptly if you believe your account has been accessed without permission.
4. Plans, trials and billing
- Paid subscriptions are billed through Shopify, every 30 days or yearly where an annual plan is offered, in US dollars, and appear on your Shopify invoice.
- Free trials are free. If you cancel before the trial ends, you are not charged. Each store can use one free trial per App.
- Each plan has limits, such as the number of products, functions, collections, devices, locations, scans or orders. When you reach a limit, the affected feature may pause until the next billing period or until you upgrade. If you move to a plan that doesn’t include a feature you use, that feature or the rules that depend on it are paused, not deleted.
- You can change or cancel your plan at any time. Uninstalling an App cancels its subscription. Refunds are covered by our refund policy.
- We may change plan prices for new subscriptions. Existing subscriptions keep their price unless you approve a change in Shopify.
5. AI features
Some Apps draft rules or suggest changes with AI. AI output can be wrong or incomplete: review and test it before you publish or apply it. Nothing is changed in your store until you apply it, and you are responsible for what you apply, whether you built it yourself or started from an AI draft, a recommendation or a template.
6. App-specific terms
FunctionFlow AI. The App lets you create, test, publish and manage Shopify Functions: discount, shipping, payment and checkout validation rules. You are responsible for discount amounts, payment and shipping availability and checkout restrictions you publish. Shopify limits how many functions of each kind can be active in a store. When you uninstall, Shopify removes the App’s functions from your checkout.
SmartSort AI. The App ranks products and changes the manual sort order of the collections you choose, and, depending on your plan, adds or removes product tags you configure and adds an anonymous analytics pixel to your storefront. Collection order and tags are visible to your customers and may affect other apps, themes or automated collections that rely on them. We don’t guarantee that every scheduled sort runs at the exact time chosen, or any particular increase in sales or conversions. When you uninstall, your collections keep the last order the App applied; restore a collection’s original sort order in the App first if you want Shopify’s previous sorting back.
ShipRule. The App lets you create rules that hide, show, rename and reorder the delivery options buyers see at checkout. You are responsible for which delivery options your customers can choose. When you uninstall, your checkout shows Shopify’s normal delivery options.
Rack Scanner. The App and its mobile apps let your team count inventory, update stock levels and pick and pack orders with a phone camera. Rack Scanner writes the quantities your team submits and warns when stock changed during a count, but you remain responsible for reviewing counts before submitting them. Device connections expire after 24 hours and can be revoked by the merchant at any time. Use of the mobile apps is also subject to the terms of the Apple App Store or Google Play.
7. Acceptable use
Don’t use the Service to break the law, to interfere with the Service or Shopify, to access other merchants’ data, to send false data to our endpoints (such as the storefront pixel), to probe or overload our systems, or to copy or reverse engineer the Service. We may suspend access that puts the Service, Shopify or other merchants at risk.
8. Your data and our Service
You keep ownership of your store data and the rules, settings and content you create. You give us permission to use them only to provide and support the Service. We own the Service, including its software, design and documentation. If you send us ideas or feedback, for example on the Rack Scanner feedback board, we may use them without obligation to you. Our privacy policy explains how we handle personal information.
9. Third-party services
The Service relies on Shopify and, for some features, on other providers such as OpenAI, Apple and Google. Their services are governed by their own terms, and we aren’t responsible for their availability or actions.
10. Availability
We work to keep the Service available and reliable, but we don’t guarantee uninterrupted or error-free operation. The Apps depend on Shopify’s infrastructure, APIs, rate limits and availability.
11. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the App concerned in the 12 months before the claim.
13. Termination
You can stop using an App at any time by uninstalling it. We may suspend or terminate access for violations of these terms, or stop offering an App with reasonable notice. Sections that by their nature should survive termination, such as 8, 11, 12 and 14, continue to apply.
14. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in the State of Delaware, unless the law where you are based requires otherwise.
15. Changes to these terms
We may update these terms. We’ll change the “Last updated” date and, for material changes, notify merchants in the Apps. Continued use after a change means you accept the updated terms.
